Acceptable Usage Policy

This Acceptable Usage Policy (“AUP”) governs your use of the Services and is incorporated by reference into SirsteveHQ Limited’s Terms of Service. Unless otherwise stated, defined terms in this AUP have the meanings provided in the Terms of Service. SirsteveHQ may modify this AUP at any time without notice.

The Services provided by SirsteveHQ may only be used for lawful purposes. You agree to comply with all applicable laws, rules and regulations in connection with your use of the Services. SirsteveHQ reserves the right to refuse service to anyone. Any material that in our judgment violates this AUP in any manner may be removed from our servers (or otherwise disabled), with or without notice. Failing to respond to the alert from our abuse department within the specified time period, as mentioned in our email to you, may result in the suspension or termination of the Services.

You are responsible for the activities of your agents, representatives, and end-users (“Users”) and will they abide by this AUP. The Services shall be used solely for legitimate business and commercial purposes, and you shall not use the Services for activities which, in SirsteveHQ ‘s sole discretion, may be illegal, offensive, abusive, or in a manner that interferes with or adversely affects the Services or use of the Services (including deliberate attempts to overload a system and broadcast attacks) or that would expose SirsteveHQ to criminal or civil liability.

Purpose

This acceptable use policy aims to prevent overload of our infrastructure, abuse, and inconvenience to other users. Overloading our infrastructure or causing inconveniences to others may be caused by individual users who use much more resources than the average of similar customers. SirsteveHQ reserves the right to monitor the number of resources and filter or limit any excesses.

Prohibited Uses

You may use our sites or the services that we provide only for lawful purposes. You may not use our service:

In any way that breaks any applicable local, national, or international laws or regulations
In any way that is unlawful or fraudulent
In any way that harms or attempts to harm minors
In any way that transmits any unsolicited promotional material (spam)
In any way that transmits viruses, trojans, spyware, or similar
In any way that uses any material which is defamatory to any person
In any way that is obscene, offensive, hateful, or inflammatory
In any way that promotes violence
In any way that promotes discrimination (race, sex, religion, nationality, disability, sexual orientation, or age)
In any way that infringes copyright, database right, trademark, or other intellectual property rights
In any way that is likely to deceive any person
In any way that promotes any illegal activities
In any way that is likely to harass, upset, embarrass, alarm, or annoy any other person
In any way that is used to impersonate any person
You may not use our services for the purposes of testing security measures in any way.

Infringement of Intellectual Property Rights.

Use of the Services to infringe upon another party’s intellectual property rights is prohibited. This includes, but is not limited to, the unauthorized copying or distribution of movies, music, books, photographs, software/warez, or any other copyrighted work. Selling or offering to sell any counterfeit merchandise will result in the immediate termination of your account. Any account found to be infringing on the intellectual property rights of others will be expeditiously removed or access to the material will be disabled. Any account found to be in repeated violation of this prohibition will be suspended or terminated.

If you believe that your intellectual property rights are being infringed upon, please email abuse@sirstevehq.com. For copyright infringement claims, SirsteveHQ follows the Digital Millennium Copyright Act (“DMCA”) notice and takedown procedures.

Using a shared account as a backup/storage device.

You may not use a shared hosting account as a backup/storage device with the exception of one cPanel backup of the same account. Please do not take backups of your backups.

Unacceptable Material

Zero Tolerance Adult Content Policy

SirsteveHQ has a zero tolerance policy in effect for adult content. We do not allow any content considered “adult material” on our servers. This includes any type of media that may contain nudity, partial nudity, or anything else of adult nature determined in SirsteveHQ’s sole discretion. Violators of this policy will be immediately terminated without a refund. Additional prohibited content is outlined below:

Hacking, phishing, spamming, scamming, identity theft, fraud, forgery, deception, virus or malware distribution, network attacks, and interference with any other user’s use of the Services.
The unauthorized access, monitoring, collection, or use of data, systems or networks.
Transmitting, distributing or storing illegal or fraudulent information or material or information or material that will infringe or otherwise violate any privacy, intellectual property, publicity or other personal rights including, any copyright, patent, trademark, trade secret or other proprietary right.
Engaging in offensive activities such as harassment or transmitting or distributing content that is inappropriate, obscene, defamatory, threatening, abusive, that advocates violence, or that violates a law, regulation, or public policy.

In addition, you and your Users must comply with all applicable laws, rules and regulations related to your use of the Services, specifically including data protection and privacy laws, as well as laws relating to unsolicited commercial electronic messages.

Child Pornography Prohibited.

Content that is potentially harmful to minors, as determined in SirsteveHQ’s sole discretion, is strictly forbidden, including but not limited to, child pornography or content perceived to be child pornography. Any website found to host child pornography or linking to child pornography will be suspended immediately without notice.

Free Web Hosting Not Allowed For Resellers.

SirsteveHQ Resellers are not allowed to provide “free web hosting” services to their customers.

Fair Usage Policy

The use of SirsteveHQ's products and services are governed by a Fair Use Policy, stated here, which covers the fair use of our different hosting packages (i.e shared hosting and reseller hosting plans) bundled with limited or unlimited resources like disk space, data transfer/bandwidth, email accounts, databases and/or other resources, etc both in Nigeria and globally.

These plans are affordable because it allows many different customers to make use of the same underlying server and it will be unfair to disturb other users on the same server with your activities as it does of course have its limits.

Using any of these hosting plans under this policy primarily for online file storage (like Google Drive, Microsoft Onedrive, Dropbox etc), electronic files archiving, video or audio streaming (like Youtube etc) is prohibited. You can store the files on third party online storage sites and embed the links on your website. It is safe and legal under applicable law to upload files only directly linked to, related to and displayed on your website.

This policy provides customers with unlimited resources as they wish to use without any additional charge as their site visitors increases. Customers may use this features for any purpose as they like other than those unacceptable as stated in the Acceptable Use Policy and must stay within reasonable standards of fair use. If your site is poorly optimised, continually gets hacked or is causing issues for others on the shared servers (i.e excessive CPU, RAM, inodes or disk I/O usage, email storage per account), you will receive a notice warning upon reaching the threshold of the set limit. Usage beyond this limit may require an upgrade to a higher plan, virtual private server (VPS) in order not to affect other customers.

Should SirsteveHQ deem a customer's account as exceeding fair use of bandwidth or other resources which causes interference with other users on our servers, SirsteveHQ will notify the customer and allow the customer to rectify the problem. However, should a customers' resource usage be significantly greater than fair use, SirsteveHQ reserves the right to suspend or terminate the customers account where appropriate. SirsteveHQ will discuss the available options that could provide better service for the customer.

As a shared and reseller hosting customer, you share the total server resources such as disk space, bandwidth and other resources with other customers. In order to ensure fast & reliable service to you and all of our clients, any hosting account (i.e shared hosting and hosting reseller etc) that adversely affects the server or network performance on our shared servers must correct these issues or will be asked to upgrade to a VPS hosting in order not to affect other clients.

This is good news and it means your site is getting popular and you've outgrown the capabilities of shared hosting, having greater control over the software stack and being able to assign more resources to your site means you'll be able to continue to provide a great experience to your customers/visitors as your business grows.

SirsteveHQ reserves the right to add or modify the terms presented here. On this website, the terms bandwidth and data transfer are used interchangeably.

INODES.

The use of more than two hundred and fifty thousand (250,000) inodes on any shared or reseller account may result in a warning, and if no action is taken to reduce the excessive use of inodes, your account may be suspended. If an account exceeds one hundred thousand (100,000) inodes it will be automatically removed from our backup system to avoid over-usage, however, databases will still be backed up as a courtesy in our sole discretion. Every file (i.e. a webpage, image file, email, etc.) on your account uses up one (1) inode.

User accounts that constantly create and delete large numbers of files on a regular basis, have hundreds of thousands of files, or cause file system damage may be flagged for review and/or suspension. The primary cause of excessive inodes is typically due to Users leaving their catchall address enabled, but never checking their primary account mailbox. Over time, tens of thousands of messages (or more) build up, eventually pushing the account past an acceptable amount of inodes. To disable your default mailbox, login to cPanel and choose “Mail”, then “Default Address”, “Set Default Address”, and then type in: “:fail: No such user here”.

Note: The inode restrictions do not impact SirsteveHQ CP hosting packages, encompassing our Cloud and WordPress hosting. These packages have no LVE constraints, though they must adhere to other guidelines outlined in our Acceptable Use Policy (AUP).

Zero Tolerance Spam Policy

We take a zero tolerance stance against the sending of unsolicited e-mail, bulk emailing, and spam. “Safe lists,” purchased lists, and selling of lists will be treated as spam. We may terminate the account of any User who sends out spam with or without notice.

Websites advertised via spam (Spamvertised) may not be hosted on our servers. This provision includes, but is not limited to, spam sent via fax, phone, postal mail, email, instant messaging, or usenet/newsgroups. No organization or entity listed in the ROKSO may be hosted on our servers. Any User account which results in our IP space being blacklisted will be immediately suspended and/or terminated.

SirsteveHQ reserves the right to require changes or disable as necessary, any website, account, database, or other component that does not comply with our policies, or to make any such modifications in an emergency that we deem necessary at our sole discretion.

SirsteveHQ reserves the right to charge the holder of the account used to send any unsolicited e-mail a cleanup fee or any charges incurred for blacklist removal at our sole discretion.

WHMCS Support Policy

IP Blacklisting & Reputation

Any user who by their action or inaction whose services cause a negative IP reputation or IP blacklisting may be fined per IP for the cleanup of our IPs.

VPN & Proxy Services

VPN and Proxy services are usually used to hide the originating user’s IP and/or location. As this interferes with our legal obligations relating to security, finance, and taxation accessing our services via VPN or Proxy is expressly forbidden.

Social Media

While using social media is the trend to voice opinions it’s also used as a platform to abuse companies and to extort them with negative publicity. Such examples might be jumping the support queue or getting discounts from the Sales team. Abusing SirsteveHQ on social media is something we have a zero-tolerance against. You can of course voice dissatisfaction, however, we expect that customers remain polite and civil. Abusive behaviour on social media can result in account termination. Where appropriate we may report abusive or offensive content to the relevant authorities.

Information Sharing Without Consent

You may not share internal information publicly without our express written permission. This includes, but is not limited to, any personally identifiable information or company infrastructure information that might otherwise place the company and its employees at risk.

Defamation Policy

Websites hosted on SirsteveHQ’s servers are regulated by the Nigeria law. Accordingly, pursuant to Section 230(c) of the Communications Decency Act, SirsteveHQ’s policy is not to remove allegedly defamatory material from websites hosted on our servers unless the material has been found to be defamatory by a court, as evidenced by a court order. As a webhost, SirsteveHQ is not a publisher of User content, and we are not in a position to investigate the veracity of individual defamation claims. We rely on the legal system and the courts to determine whether or not material is indeed defamatory. In any case in which a court order indicates that material is defamatory, libelous, or slanderous in nature, we will disable access to the material. Similarly, in any case in which a Nigeria court has placed an injunction against specified content or material being made available, we will comply and remove or disable access to the material in question.

SirsteveHQ’s Rights

SirsteveHQ reserves the right at all times to investigate any actual, suspected, or alleged violations of this AUP. You shall reasonably cooperate with SirsteveHQ in investigating and correcting any actual or alleged breach of this AUP by yourself of any User. SirsteveHQ further reserves the right to cooperate with legal authorities and third parties in investigating any alleged violations of this AUP, including disclosing the identity of any User that SirsteveHQ believes is responsible for such violation. SirsteveHQ may implement technical mechanisms to prevent AUP violations.

Nothing in this AUP shall limit SirsteveHQ’s rights and remedies at law or in equity that may be available.

Disclaimer

SirsteveHQ is under no duty to monitor user’s activities, and SirsteveHQ disclaims any responsibility for any User’s misuse of the Services. SirsteveHQ has no responsibility for any User or other third-party material, or information created, stored, maintained, transmitted or accessible on or through the Services, and is not obligated to monitor or exercise any editorial control over such material. In the event that SirsteveHQ becomes aware that any such material violates this AUP and/or exposes SirsteveHQ to civil or criminal liability, SirsteveHQ may, but is not required to, block access to such material. Unless otherwise stated in this AUP, SirsteveHQ disclaims any obligation to any person who has not entered into an agreement with SirsteveHQ for use of the Services.

AUP Violations

Your Services may be terminated with or without notice upon any violation of this AUP. If applicable, violations will be reported to the appropriate law enforcement agency.

A failure to respond to an email from our abuse department within twenty-four (24) hours, or as otherwise specified in the email, may result in the suspension or termination of your Services. All abuse issues must be dealt with via trouble ticket/email and will receive a response within twenty-four (48) hours.
