Acceptable Use Policy

This acceptable use policy governs your use of the services we provide (“Hosting Services”). Your use of the Hosting Services means that you accept, and agree to abide by, all the policies in this acceptable use policy, which supplement our terms and conditions. SIRSTEVEHQ LIMITED may modify this Acceptable Use Policy at any time without notice.

You must not allow a third party to access or use the Hosting Services. If you have purchased one of our reseller hosting packages, you can allow a third party (a “Third Party”) to access or use the Hosting Services. If you do so, they will also be regulated by this acceptable use policy. As such, you will monitor the use of the Hosting Services by a Third Party and you will procure that they abide by this acceptable use policy. A breach of this acceptable use policy by a Third Party will be deemed to be a breach of this acceptable use policy by you.

The Hosting Services are provided by SIRSTEVEHQ LIMITED (“we”, “us” and “our”). We are a company registered in Nigeria under the Corporate Affairs Commission (CAC) with registration number 2005533, and our registered office is located at Km 11, Idiroko Road, Ota, 112104, Ogun State, Nigeria.

A. Resource usage

• 1. The Shared Hosting Services comprise the provision of web space on our servers to enable you to upload pages and files for the purpose of publishing websites.
• 2. The Shared Hosting Services allow you ‘unlimited’ server space for normal routine “non-file-distribution” web usage. For websites that allow downloading of video, audio or other files we reserve the right to impose a bandwidth limit of two hundred and fifty (250) gigabytes per calendar month.
• 3. Non-file-distribution usage will remain unaffected by any limit imposed on downloading of video, audio or other files.
• 4. In your use of the Shared Hosting Services (other than where you are using your own virtual private server), you may not:
  • a. use more than 10% of our platform's processing capacity. There are numerous activities that could cause such problems, including (but not limited to) CGI scripts and intensive FTP, PHP or HTTP operations
  • b. run stand-alone, unattended server-side processes or any daemons; including (but not limited to) IRCd
  • c. run any type of web spider or indexer
  • d. run any software that interfaces with an Internet Relay Chat network
  • e. run any bit torrent application, tracker, or client. You may link to legal torrent files off-site, but may not host or store them on our servers
  • f. participate in any file-sharing/peer-to-peer activities
  • g. run any gaming servers
  • h. run entries or other scheduled tasks other than by configuring them through our control panel
  • i. give away web space under a domain (including Resellers giving away free websites)
  • j. operate a proxy website or service
  • k. as a remote file host for other websites
  • l. operate self-hosted file sync or similar “cloud storage” based services including (but not limited to) OwnCloud, Pydio and Sparkleshare.
• 5. You must not use the Hosting Services as an offsite backup facility. Therefore, all files uploaded to our servers as part of your usage of the Hosting Services must be visible and accessible to the outside world (web-visible) unless they are needed to operate the website of which they form part; We reserve the right to delete files or directories that are not web-visible without giving notice to you.
• 6. All pages of website stored on our servers as part of the Hosting Services will be available to search engines unless you take action to prevent this. If you wish to optimise your web pages for search engines you agree to use coding and techniques which comply fully with the guidelines issued by Google, Bing, Yahoo and other large search engines.
• 7. MySQL Databases are limited to 1024 megabytes in size, when they reach this size we will notify you.
• 8. If you are a Reseller and deactivate a resold web hosting account we will delete it after 50 days.

B. Prohibited uses

• 1. You may use the Hosting Services only for lawful purposes. You may not use the Hosting Services:
  • a. in any way that breaches any applicable local, national or international law or regulation
  • b. in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect
  • c. for the purpose of harming or attempting to harm minors in any way
  • d. to send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards (see below)
  • e. to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (also known as SPAM - see below) to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware

C. Content standards

• 1. These content standards apply to any and all material that you allow to be hosted through the Hosting Services and to any interactive services associated with it.
• 2. You must comply with the spirit of the following standards. The standards apply to each part of any Material as well as to its whole.
• 3. Material must:
  • a. be accurate (where they state facts)
  • b. be genuinely held (where they state opinions)
  • c. comply with applicable law in Nigeria and in any country from which they are posted
• 4. Material must not:
  • a. contain any material which is defamatory of any person
  • b. contain any material which is obscene, offensive, hateful or inflammatory
  • c. contain any material that is pornographic
  • d. promote violence
  • e. promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age
  • f. infringe any copyright, database right or trade mark of any other person
  • g. be likely to deceive any person
  • h. be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence
  • i. promote any illegal activity
  • j. be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety
  • k. be likely to harass, upset, embarrass, alarm or annoy any other person
  • l. be used to impersonate any person, or to misrepresent your identity or affiliation with any person
  • m. give the impression that they emanate from us, if this is not the case
  • n. advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse
• 5. Unacceptable material on our servers include without limitation:
  • Topsites
  • Any website related to Cannabis, CBD is strictly forbidden.
  • MP3’s or any other formats of copyrighted music
  • Movies or any other formats of copyrighted video
  • Any content that is illegal under Nigeria law
  • Bittorrent trackers
  • Open SMTP relays or improperly configured mail servers
  • Recursive DNS services
  • Any scripts that may cause a degradation in the performance of our servers or network
  • IRC Scripts/Bots
  • IRCD (irc servers)
  • Proxy Scripts/Anonymizers
  • Image Hosting Scripts (similar to Photobucket or Tinypic)
  • AutoSurf/PTC/PTS/PPC sites
  • IP Scanners
  • Bruteforce Programs/Scripts/Applications
  • Mail Bombers/Spam Scripts
  • Banner-Ad services (commercial banner ad rotation)
  • File Dump/Mirror Scripts (similar to rapidshare)
  • Commercial Audio Streaming (more than one or two streams)
  • Escrow/Bank Debentures
  • High-Yield Interest Programs (HYIP) or Related Sites
  • Investment Sites (FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi, MLM/Pyramid Scheme)
  • Sale of any controlled substance without prior proof of appropriate permit(s)
  • Prime Banks Programs
  • Lottery/Gambling Sites
  • MUDs/RPGs/PBBGs
  • Hacker focused sites/archives/programs
  • Sites promoting illegal activities
  • Forums and/or websites that distribute or link to warez/pirated/illegal content
  • Bank Debentures/Bank Debenture Trading Programs
  • Fraudulent Sites (Including, but not limited to sites listed at aa419.org & escrow-fraud.com)
  • Mailer Pro
  • Push button mail scripts
  • Broadcast or Streaming of Live Sporting Events (UFC, NASCAR, FIFA, NFL, MLB, NBA, WWE, WWF, etc)
  • Tell A Friend Scripts
  • Anonymous or Bulk SMS Gateways
  • Bitcoin Miners
  • PayDay Loan Sites (including any site related to PayDay loans, PayDay loan affiliate programs, etc)
  • Hacking, phishing, spamming, scamming, identity theft, fraud, forgery, deception, virus or malware distribution, network attacks, and interference with any other user’s use of the Services.
  • The unauthorized access, monitoring, collection, or use of data, systems or networks.
  • Transmitting, distributing or storing illegal or fraudulent information or material or information or material that will infringe or otherwise violate any privacy, intellectual property, publicity or other personal rights including, any copyright, patent, trademark, trade secret or other proprietary right.
  • Engaging in offensive activities such as harassment or transmitting or distributing content that is inappropriate, obscene, defamatory, threatening, abusive, that advocates violence, or that violates a law, regulation, or public policy.

D. Zero Tolerance Spam Policy

• 1. We take a zero tolerance stance against the sending of unsolicited email, bulk emailing and spam. We may terminate the account of any user who send out spam with or without notice
• 2. Websites advertised as spam may not be hosted on our servers. This provision includes, but is not limited to, spam sent via fax, phone, postal mail, email, instant messaging or newsgroups. Any user account which results in our IP space being blacklisted will be immediately suspended and/or terminated.
• 3. SIRSTEVEHQ LIMITED reserves the right to require changes or disable as necessary any website, account, database or component that does not comply with our policy
• 4. SIRSTEVEHQ LIMITED reserves the right to charge the holder of the account used to send any unsolicited email, a clean-up fee or any charges incurred for blacklist removal at our sole discretion

E. Reselling

• You agree not to:
  • a. re-sell or offer for the use of third parties any part of our Hosting Services unless a specific Reseller product has been purchased,
  • b. not to access without authority, interfere with, damage or disrupt
    • i. any part of the Hosting Services
    • ii. any equipment or network used to provide the Hosting Services
    • iii. any software used in the provision of the Hosting Services
    • iv. any equipment or network or software owned or used by any third party
  • c. If you deactivate a resold Hosting Service for 50 consecutive days we will automatically delete this Hosting Service.
  • d. You are responsible for the good housekeeping of your Reseller Service. You agree to delete files and Hosting Services that are no longer required

F. Unlimited/Unmetered Explained

• What "Unlimited/Unmetered" means: Unlimited/Unmetered Disk Space/Bandwidth/Website Plans. This means that we do not set a limit on the amount of bandwidth, websites or disk space you may use in the normal operation of a personal or small business website, provided it complies with this Agreement. However, in the event your service usage or content presents a risk to the stability, performance or uptime of our servers, data storage, networking or other infrastructure, you may be required to upgrade to a VPS or a Cloud Server, or we may take action to restrict the resources your website is utilizing.
• What "Unlimited" DOES NOT mean: SIRSTEVEHQ LIMITED employs complex mechanisms to protect its hosting Subscribers and systems from any kind of abuse. SIRSTEVEHQ's "Unlimited" hosting offering is not for single or few hosting subscribers to unfairly or adversely impact the experience of other hosting Subscribers. SIRSTEVEHQ's service is offering shared hosting service, which means that multiple hosting Subscriber's websites are hosted from the same server and share server resources. SIRSTEVEHQ's service is designed to meet the typical needs of small and medium sized businesses across globe. It is NOT intended to support the sustained demand of large enterprises, or non-typical applications better suited to a VPS or a Cloud server. SIRSTEVEHQ will make every commercially reasonable effort to provide additional resources to Subscribers who are using their website(s) consistent with these Terms, including moving Subscribers to newer and bigger shared servers as necessary. However, in order to ensure a consistent and quality experience for all Subscribers, SIRSTEVEHQ does place automated safeguards to protect against any website growing too quickly and adversely impacting the system until SIRSTEVEHQ can evaluate said sites resource needs.
• Unlimited Hosting Space; excessive SQL Database: SIRSTEVEHQ does not set any specific limits on the amount of disk space a hosting subscriber can use for their website, nor does SIRSTEVEHQ charge additional fees based on an increased amount of storage used, provided the hosting subscriber's use of storage complies with these Terms. Please note, however, that the SIRSTEVEHQ service is designed to host websites. SIRSTEVEHQ does NOT provide unlimited hosting for online storage, videos, images, audio, games, installers, executable files, backups, or archiving of electronic files, documents, log files, web spider or indexer, irc, torrent, file sharing, peer-to-peer activities, testing environment etc., and any such prohibited use of the Services will result in the termination of hosting subscriber's account, with or without notice. Accounts with an excessive database size (i.e., more than 1 GB) negatively affect the performance of the server. SIRSTEVEHQ may request that the database size be reduced to ensure proper performance or may disable the Subscriber's account, with or without notice. Hosting subscriber's can create multiple databases however size of each database should not be more than 1 GB.
• Unlimited File Transfer: SIRSTEVEHQ does not set any limits on the amount of visitor traffic a website can receive or on the amount of content a hosting subscriber can upload to his/her/its website in a given month, nor does SIRSTEVEHQ charge additional fees based on increased use of bandwidth, as long as the hosting subscriber's use of the Services complies with these Terms. In most cases, a hosting subscriber's website will be able to support as much traffic as the hosting subscriber can legitimately acquire. However, SIRSTEVEHQ reserves the right to limit processor time, bandwidth, processes, or memory in cases where it is necessary to prevent negatively impacting other hosting subscribers.

G. Suspension and termination

1. We will determine, in our discretion, whether there has been a breach of this acceptable use policy through your use of the Hosting Services. When a breach of this policy has occurred, we may take such action as we deem appropriate.

2. Failure to comply with this acceptable use policy constitutes a material breach of our terms and conditions of sale upon which you are permitted to use the Hosting Services, and may result in taking all or any of the following actions:
   • a. immediate, temporary or permanent withdrawal of your right to use the Hosting Services
   • b. immediate, temporary or permanent removal of any Material (as defined in paragraph 5.1) uploaded to our servers
   • c. issue of a warning to you
   • d. issue of legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach
   • e. further legal action against you
   • f. disclosure of such information to law enforcement authorities as we reasonably feel is necessary

3. SIRSTEVEHQ LIMITED reserves the right at all times to investigate any actual, suspected, or alleged violations of this AUP. You shall reasonably cooperate with SIRSTEVEHQ LIMITED in investigating and correcting any actual or alleged breach of this AUP by yourself of any User. SIRSTEVEHQ LIMITED further reserves the right to cooperate with legal authorities and third parties in investigating any alleged violations of this AUP, including disclosing the identity of any User that SIRSTEVEHQ LIMITED believes is responsible for such violation. SIRSTEVEHQ LIMITED may implement technical mechanisms to prevent AUP violations.Nothing in this AUP shall limit SIRSTEVEHQ LIMITED's rights and remedies at law or in equity that may be available.

H. Disclaimer

• SIRSTEVEHQ LIMITED is under no duty to monitor user’s activities, and SIRSTEVEHQ LIMITED disclaims any responsibility for any User’s misuse of the Services. SIRSTEVEHQ LIMITED has no responsibility for any User or other third-party material or information created, stored, maintained, transmitted or accessible on or through the Services, and is not obligated to monitor or exercise any editorial control over such material. In the event that SIRSTEVEHQ LIMITED becomes aware that any such material violates this AUP and/or exposes SIRSTEVEHQ LIMITED to civil or criminal liability, SIRSTEVEHQ LIMITED may, but is not required to, block access to such material. Unless otherwise stated in this AUP, SIRSTEVEHQ LIMITED disclaims any obligation to any person who has not entered into an agreement with SIRSTEVEHQ LIMITED for use of the Services.

I. AUP Violations

• Your Services may be terminated with or without notice upon any violation of this AUP. If applicable, violations will be reported to the appropriate law enforcement agency.A failure to respond to an email from our abuse department within forty-eight (48) hours, or as otherwise specified in the email, may result in the suspension or termination of your Services. All abuse issues must be dealt with via trouble ticket/email and will receive a response within forty-eight (48) hours.

J. Changes to our acceptable use policy

• We may revise this acceptable use policy at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are legally binding on you.
